SCOPE

Exist Centers, LLC and our affiliates, subsidiaries, and contractors (“Exist,” “we,” “our,” and “us”) provide individualized, outpatient substance use and mental health treatment services to adults. This Exist Center’s LLC Privacy Policy (“Privacy Policy”) was developed to give you information about how we collect, use, and share personal information processed by us on our websites (e.g. https//www.existcenters.com) and other online and offline offerings and to help you utilize and understand your privacy rights. All offerings, including our website, will be collectively called “Services” throughout this Policy. We may also provide other privacy policies during other times we collect personal information, set forth in separate writing, and those terms will govern such data collection, privacy, and usage. HIPAA NOTICE OF PRIVACY PRACTICES

This Privacy Policy is not applicable to our collection, usage, and disclosure of “Protected Health Information” as a “Covered Entity” under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”). As a Covered Entity, when you become a client of Exist Centers, we will provide you with a specific HIPAA Notice of Privacy Practices consent form that will thoroughly explain our privacy practices related to the collection of your private medical information when engaging in our clinical services provided by health care clinicians.

 

THE PERSONAL INFORMATION WE COLLECT

Legal privacy requirements and how you interact with our Services both change the type of personal information we may collect from you. Some of the information we collect you actively choose to provide us, some information we collect automatically, and other information is obtained from other sources like third-party services, as described below. All personal information we collect will herein collectively be referred to as “Your Information”.

 

Information You Choose To Provide Us

The information described below is information you directly provide us when interacting with our Services. 

Demographics: Name, date of birth, age, marital status, military or veteran status, race or national origin, vocation, education, or family-related information, street address, city, state, email address, and other demographic information. 

Personal Health Information: Medical history, prior and current diagnoses, health insurance policy information, medical providers, current health status, medication history, and presenting problems.

Payment Information: Payment card information including debit and/or credit card number, expiration date, CVV code, and billing zip code) and other financial information. 

Other Peoples’ Information. You may choose to provide information about a third party through our Services. Please only share the personal information of another person after you have their full consent to release said information. We also advise that you ensure any and all information you are sharing about yourself or another person is lawful and in accordance with all applicable law.

Exist Centers may collect information from other sources including provider information directly provided in Your Information. We may also collect information from business partners and other service providers with whom we have business relationships with.

Exist Centers uses your information in a variety of ways including to provide and develop our Services, for administrative purposes, for marketing and advertising, to effectively communicate with you, and to address legal concerns.

Provide and develop our Services. Provide the services currently available by gathering personal information including how to contact you and collecting information on who finds our Services and why to better serve our community and their demand.

Administrative purposes. Direct marketing. Market research. Internal quality control. Auditing internal departments. Enforcing our policies.

We do not and will not sell Your Information to third parties for monetary gain. However, we may share your information with third-parties for reasons listed below:

To provide our Services. Your Information that we collect will be used to provide you with any and all of our Services, including those that utilize third-party services such as payment processing, customer service, insurance utilization, and requested referrals for clients deemed inappropriate for our Services. We may also disclose your information to business partners who participate in co-branded partnerships with Exist Centers including independently contracted clinicians and organizations. 

To protect us and others. We may disclose Your Information to external parties if we believe in good faith that it is appropriate in accordance with or required by law (e.g. subpoenas, human rights violations, policy enforcement, debt collection, illegal activity). 

Merger, sale, or transfer. We may disclose Your Information to any parent, subsidiary, or affiliate of Exist Centers as well as any subsequent owner or parties involved in a merger, restructure, or other corporate change as part of such transaction.

Imminent threat. We reserve the right to call 911 or 988 when user appears to present imminent danger to themselves or someone else/others. We will provide any and all information required to ensure the safety within the situation.

With your permission. We may share Your Information with other third-party providers when given your consent to do so.

Anonymized or aggregated information. This type of information does not personally identify you and may be shared internally and with third parties for any purpose.

 

YOUR PRIVACY RIGHTS, CHOICES, AND THE ABILITY TO MANAGE YOUR INFORMATION

You are responsible for ensuring the accuracy of Your Information. If you’d like to review or remove Your Information that has been collected from Exist Centers, you may contact us using the information in the “CONTACT US” section below. Upon review, we will, in good faith, make said changes or remove desired personal information. You may also unsubscribe from our email newsletter using the link provided at the bottom of the email. Additionally, while you may activate a DNT (“Do Not Track”) privacy preference in your web browser, we advise you fully understand that we do not adhere to nor respond in accordance with DNT or similar mechanisms.

These privacy rights apply to any California resident that Exist Centers has collected personal information about including from any source, by the use of our Services or by you directly communicating with us in person or via mail or electronic correspondence. We will respond to your request within forty-five (45) days for a twelve (12) month period and no more than two times per twelve (12) month period.

California “Shine the Light” law

This law permits California residents to request and obtain a list obtaining information from Exist Centers once a year, for free, regarding any and all releases of Your Information to third party providers or partners for their own direct marketing purposes in the prior calendar year. 

We do not disclose Your Information to third parties for their own purposes.

Our Services, including our Website, are not intended for anyone under the age of 13 (or any other age as required by local law). We do not knowingly collect personal information from children under the age of 13. If we become aware that we have collected personal information of a child under 13, we will delete any and all personal information obtained, within legal law requirements, and will delete the child’s account if applicable.
